Announcement of proposed issues

If the municipality of Gemert-Bakel intends to sell, encumber, lease or give into use immovable property (e.g. land, premises), it must publicly announce this. This is to give everyone equal opportunities.

Are you also a candidate or do you disagree with an issue?

After 20 calendar days from the date of this publication, the municipality of Gemert-Bakel will give further effect to its intention to enter into the purchase agreement, unless interim relief proceedings against this intention have previously been instituted by an interested party with the interim relief judge of the District Court of Oost Brabant. For further information, please contact the municipality at gemeente@gemert-bakel.nl.

No response or too late?

If you do not respond to a proposed issuance within 20 days, you will forfeit your right to take legal action against the decision and entering into the agreement or claim damages.

What happens after 20 days?

If no notice is received within 20 days of the publication of a proposed issuance, the Municipal Executive may make a decision on entering into the agreement. We maintain these 20 days, otherwise the municipality of Gemert-Bakel and its contracting parties will be unreasonably disadvantaged.

Issue

Below you will find all the land, buildings, parcels, and building lots that we intend to dispose of.

Proposed sale of three commercial lots to Leije in Gemert

We plan to sell three adjacent commercial lots on Leije in Gemert. The lots in question are:

ParcelCadastral designationAreaMethod of Issuance
 1Gemert-O-39695,133 m²Public allocation procedure by lottery
 2Gemert-O-39705,133 m²Public allocation procedure by lottery
 3Gemert-O-39684,149 m²Direct sale

We offered lots 1 and 2 through a public allocation procedure. The opportunity to apply and the associated allocation terms were announced on May 19, 2026. A lottery was held on June 15, 2026. Based on the lottery results, the selected companies are eligible to purchase the lots. The proposed sales will take place in accordance with the previously announced terms and conditions.

Lot 3 is not included in the lottery procedure. We intend to sell this lot directly to the owner of the adjacent commercial lot. We believe that, based on objective, verifiable, and reasonable criteria, the business owner is the only serious candidate eligible to purchase this lot. In this regard, we consider it important that:

  • The parcel will be used to expand the immediately adjacent commercial parcel;
  • the parcel is consistent with the existing business operations of the adjacent company;
  • The proposed expansion is consistent with the municipality’s land allocation and development objectives for the industrial park.

Opportunity to comment

We will proceed with the plan to enter into the purchase agreement 20 calendar days after the date of this publication, unless an interested party has previously filed a motion for preliminary relief against this intention with the judge presiding over preliminary relief matters at the Oost Brabant District Court.
